Terms of Use – Organize.Chat

1. Identification

The application Organize.Chat is a multi-channel communication platform owned by Organize na Prática Tecnologia Ltda., registered under CNPJ No. 05.560.260/0001-35, headquartered at Av. Eng. Luís Carlos Berrini, 1681, Suite 111 – Annex 1022, Cidade Monções, São Paulo – SP, Brazil, hereinafter referred to as 'Organize.Chat'.

By accessing or using the Organize.Chat platform, the user acknowledges that they have read, understood, and agreed to these Terms of Use in full.

2. Service Description

Organize.Chat is a Software as a Service (SaaS) platform designed to enable multi-channel communication management, integrating WhatsApp, Facebook, Instagram, Telegram, Email, Website, and Line into a unified interface.

Access is restricted to registered clients, and usage requires prior payment of a monthly or annual subscription. User credentials are sent via email after confirmation of payment.

3. Independence and Liability Disclaimer

Organize.Chat is not affiliated with, endorsed by, or representative of WhatsApp, Meta Platforms, Inc., or any other third-party communication provider. Integrations are made through public APIs or authorized connections (such as WhatsApp Cloud API or WhatsApp Web) in accordance with the terms of each respective platform.

Organize.Chat shall not be held liable for interruptions, blocking, instability, or operational decisions made by third parties, including but not limited to Meta Platforms, Inc., internet service providers, or external APIs.

4. Registration, Access, and Security

Access credentials are provided to the user following payment confirmation. Users are prohibited from sharing login credentials with other individuals.

Each account holder is solely responsible for maintaining the confidentiality of their credentials.

Organize.Chat employs SSL/HTTPS encryption and maintains access logs in compliance with the Brazilian General Data Protection Law (LGPD) and the EU General Data Protection Regulation (GDPR).

5. Data and Storage

During the use of the platform, the following data may be collected and stored: name, phone number, company name, and exchanged messages across connected channels.

All data is stored on Organize.Chat's dedicated servers hosted in Hetzner Data Center (Germany) and is not shared with third parties, except when required by law.

Data is retained for up to six (6) months after account termination and permanently deleted thereafter unless earlier deletion is requested under the Privacy Policy.

6. User Responsibilities

Violation of these obligations may result in immediate suspension or termination of the account without refund.

7. Plans, Payments, and Cancellations

Plans are billed monthly or annually and processed via credit card, bank slip (boleto), or PIX, using the Asaas and Digital Manager Guru payment gateways.

There is no free trial. In case of cancellation, no prorated refund is granted; the service remains active until the end of the billing cycle.

Failure to make payment may result in automatic account suspension after five (5) days.

8. Limitation of Liability

Organize.Chat's liability is limited to the amount effectively paid by the client in the three (3) months prior to the event giving rise to a claim.

9. Third-Party Technology and Open Source Licenses

Organize.Chat is developed using the open-source Chatwoot software, maintained by Chatwoot, Inc., under the MIT license.

Organize.Chat independently hosts, customizes, and maintains its own instance and has no corporate or contractual affiliation with Chatwoot, Inc.

10. Intellectual Property

All content, source code, design, and documentation within Organize.Chat are the exclusive property of Organize na Prática Tecnologia Ltda., protected by copyright and intellectual property laws.

The client authorizes Organize.Chat to use their logo and testimonial in promotional materials, websites, and social media, which may be revoked upon written request.

11. Updates to the Terms

Organize.Chat reserves the right to update these Terms of Use at any time, with notice provided via email or within the platform.

Continued use of the service after such updates constitutes acceptance of the revised terms.
